1. Acceptance of Terms

By accessing or using GenderReveal.day ("the Service"), operated by Aguirre Labs LLC, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

You must be at least 18 years old or the age of majority in your jurisdiction to use this Service. By using the Service, you represent that you meet this age requirement.

2. Service Description

GenderReveal.day is a platform that allows users to create interactive, shareable gender reveal experiences. The Service enables you to:

• Build personalized experiences with games, scenes, and a reveal moment
• Share your experience via a unique link with family and friends
• Collect video reactions and messages from viewers
• View analytics about who viewed your experience

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for extended periods.

4. Purchases and Pricing

GenderReveal.day uses a freemium model with three tiers:

• Free ($0): Create and publish experiences with basic features, up to 3 games, 3 scenes, 10 unique viewers (waitlist after), and 30-day hosting
• Standard ($12.99, regularly $14.99): Up to 5 games, 5 scenes, 100 viewers, 15 video reactions, premium games and customizations, media uploads, and 90-day hosting
• Forever ($19.99, regularly $24.99): Unlimited games, scenes, viewers, and video reactions. Includes reaction montage, custom URL slug, no branding, and hosting that never expires

All prices are in USD and may be subject to applicable taxes. Where required by law (such as in the EU), prices displayed will include applicable taxes. Promotional discounts may apply. Payment is processed securely through Stripe. We reserve the right to change pricing with at least 30 days advance notice. Price changes will not affect existing purchases.

5. Refund Policy

Our refund policy is designed to be fair while recognizing the digital nature of our product:

Why this policy? GenderReveal.day uses a freemium model where you can create and publish experiences for free. Paid upgrades unlock additional features, higher limits, and premium content. You can fully explore the free tier before deciding to upgrade, so you know exactly what you are paying for.

Chargebacks: If you dispute a charge with your bank or credit card company after using premium features, we may suspend your account and any associated experiences pending resolution.

6. Acceptable Use

You agree not to use the Service to:

• Upload, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Upload content that infringes on intellectual property rights of others
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any accounts or systems
• Use the Service for any commercial purpose other than creating personal gender reveal experiences
• Share content that sexualizes minors or promotes violence

Shared experience links are intended for recipients aged 13 and older. Experience creators are responsible for sharing links only with appropriate audiences.

We reserve the right to remove any content and terminate any account that violates these guidelines without notice or refund.

7. Content Ownership

Your Content: You retain all ownership rights to the content you upload (photos, text, etc.). By uploading content, you grant us a limited license to host, store, display, and transmit your content solely for the purpose of providing the Service.

Video Reactions: Video reactions recorded by viewers are owned by the experience creator. By recording a reaction, viewers grant the experience creator permission to view, download, and share their reaction.

License Termination: When you delete your experience or when it expires, our license to your content terminates, and we will delete your content from our servers.

8. Intellectual Property

The Service, including its original content (excluding user content), features, functionality, design, branding, and software, is owned by Aguirre Labs LLC (operating as GenderReveal.day) and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or software without our prior written consent.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for breach of these Terms or illegal activity. For paid users, if we terminate your account without cause, you will receive a pro-rata refund for any unused portion of paid services.

You may delete your account at any time from your account settings or by contacting us at support@genderreveal.day. We will process account deletion requests within 30 days. Upon termination, your right to use the Service will cease immediately.

10. Disclaimers and Limitations

As-Is Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Guarantee: We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any delays, delivery failures, or other damage resulting from limitations beyond our control.

Limitation of Liability: To the maximum extent permitted by law, GenderReveal.day shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. This arbitration provision does not apply where prohibited by applicable law, including for consumers in the European Union or European Economic Area who retain the right to bring claims in their local courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Service.
